Judge: Texas can't cut funds to Planned Parenthood

(AP) ? A federal appeals court ruled Friday that Texas cannot ban Planned Parenthood from receiving state funds, at least until a lower court has a chance to hear formal arguments.

A three-judge panel of the Fifth Circuit Court of Appeals agreed Friday with a lower court that there's sufficient evidence the state's law preventing Planned Parenthood from participating in the Women's Health Program is unconstitutional. The program provides basic health care and contraception to 130,000 poor women.

District Court Judge Lee Yeakel had issued an injunction keeping Texas from enforcing the law on Tuesday, but Texas Attorney General Greg Abbott appealed to the Fifth Circuit in New Orleans.

On Friday, the court said Texas Attorney General Greg Abbott hadn't shown that Texas would be irreparably harmed by holding off on enforcing the new law until a trial can be held in Austin.

The so-called affiliate rule passed last year by the Republican-controlled Texas Legislature forbids state agencies from providing funds to an organization affiliated with abortion providers, even if all they share is a name. Eight Planned Parenthood clinics that do not provide abortions sued the state. They claimed the law violated their rights to freedom of speech and freedom of association.

"This case isn't about Planned Parenthood; it's about the women who rely on Planned Parenthood for cancer screenings, birth control, and well-woman exams," said Cecile Richards, president of the Planned Parenthood Action Fund. "We won't let politics interfere with the health care that nearly 3 million people a year rely on Planned Parenthood for in Texas and around the country."

Catherine Frazier, spokeswoman for Gov. Rick Perry, said the state would explore all available legal options.

"Today's developments do not change our concerted effort in coordination with Attorney General Abbott to defend the will of Texans and our state law, which prohibits taxpayer funds from supporting abortion providers and affiliates in the Women's Health Program," Frazier said.

The federal Centers for Medicare and Medicaid Services said last month that the rule violates federal law. Federal funds paid for 90 percent of the $40 million Women's Health Program until the new rule went into effect, and federal officials are now phasing out support for the program. Perry has promised that Texas will make up for the loss of federal funds to keep the program going without Planned Parenthood's involvement.

State officials have said ending the program would result in more unplanned pregnancies that would cost the state much more than self-financing the program.

However in court papers, Texas Solicitor General Jonathan Mitchell said the state would cut all funds if the federal courts ordered Texas to allow Planned Parenthood to participate in the program.

"State law prohibits Texas from continuing to operate the Texas Women's Program if taxpayer money must be provided to entities that affiliate with abortion-promoting entities," a motion filed by Mitchell said. "Consequently, the district court's preliminary injunction effectively forces Texas to choose between contravening state law and shutting down the program."

Nikon confirms woes with D4 and D800, joins Canon in high-end doghouse

nikon-confirms-problems-with-D4-D800

Okay Nikon owners, stop laughing at your 5D Mark III cronies for their leaky problem. That might be a drip in the pail next to your own worries -- namely, possible "lock-up", focus and viewfinder hitches on your D800 or D4. Nikon verified that a "small number" of units of both DSLRs can lock up and become unresponsive, but until there's a permanent patch you can prevent this by disabling both highlight and RGB histogram displays. The company also verified that a "run" of D800s is suffering from a viewfinder bug, although it has yet to confirm another emerging problem with autofocus in some units, which apparently requires a factory fix. So, if you've noticed any of this with your pricey new D800, or really pricey D4, your best bet might be to reach out to your Nikon repair center post-haste. And don't let the Canon guys see you.

[Thanks, Thinh]

Samsung Galaxy S III software impressions (video)

Samsung Galaxy S III software impressions (video)

So, you nodded agreeably when all those hardware specs were listed, but are a bit more intrigued by what Samsung's done to the Android 4.0 interface. In short, TouchWiz is still here, but there are some noticeable differences between it and the legacy version seen on the Galaxy S II that bring the GSIII closer to a stock Android experience. But, there are also some things that are a rehash of what we saw on last year's Gingerbread hardware. We've delved into this latest interpretation, and tried out Sammy's S Voice and S Beam features along the way. Our deeper impressions are after the break, where you'll also find a quick video rundown and can see the new software in action.

George Zimmerman MySpace Page Reveals Legal Problems, Possible Racism

An old, long-unused MySpace page belonging to George Zimmerman contains apparently racist comments and casts light on his history of legal problems.

Zimmerman, who faces second-degree murder charges for killing Trayvon Martin, makes disparaging comments about Mexicans on the 2005-dated page.

He also referred triumphantly to his escape from legal troubles stemming from his confrontation with law enforcement officers, among other matters.

The page, which was confirmed as authentic Wednesday by Zimmerman’s attorney Mark O’Mara, also mentions a 7-year-old domestic violence incident.

George Zimmerman MySpace Photo

Zimmerman, 28, gained national notoriety when he shot and killed Martin, 17, in Sanford, Florida, on February 26. He was not charged at the time.

The case has sparked racial tensions around the U.S., as Martin, who was unarmed, was black. Zimmerman has a white father and Hispanic mother.

Martin’s family and supporters claim he was a victim of racial profiling, while the former neighborhood watch volunteer claims he acted in self-defense.

On the old MySpace page, called “onlytobeakingagain,” Zimmerman uses the name “Joe G” and discusses leaving his hometown of Manassas, Va.

He muses on how much he misses his friends, then vveers into a slang-filled rant, with many words misspelled, about Mexicans who lived in the area.

Zimmerman writes:

“I don’t miss driving around scared to hit mexicans walkin on the street, soft (expletive) wanna be thugs messin with peoples cars when they aint around (what are you provin, that you can dent a car when no ones watchin) don’t make you a man in my book.”

“Workin 96 hours to get a decent pay check, gettin knifes pulled on you by every mexican you run into!” he adds, providing no details about these incidents.

This, of course, has little, if anything, to do with the facts of the Martin case, but it does offer an interesting window into the mind of the defendant.

Martin family attorney Benjamin Crump said Wednesday that be believes prosecutors could use Zimmerman’s MySpace comments against him.

“It’s not just speculation and innuendo. He has a history and a habit of profiling people,” he said. “He thinks certain things about certain racial groups.”

George Zimmerman Free on Bail

A statement posted on a Zimmerman defense site run by O’Mara concedes that the comments “will cast Mr. Zimmerman in a less-than-favorable light."

O'Mara even concedes it could be used as evidence in the case. His statement says there will be no comment on the MySpace statements for that reason.

The second post mentions a legal battle with an “ex-hoe,” likely a reference to a 2005 incident in which a girlfriend accused Zimmerman of attacking her.

He was not charged in that case, and on the blog post, Zimmerman writes that the woman “tried her hardest, but the judge saw through it!”

Zimmerman’s wife testified at his bail hearing in April. during which he apologized to Trayvon Martin's family, that her husband told her he was actually defending himself in that incident, not the other way around.

A recent photo of Zimmerman's bloody head may bolster his claim that he acted in self-defense during the Martin incident, which he maintains.
